I’m confused: is my home office tax deductible?

We have a room in our house that is used exclusively as a home office. I work as a speech therapy assistant at a private school and will be using my home office space as a place for me to review client files, research disorders and familiarize myself with therapy techniques.

This space is not required by my business, nor am I meeting clients within the space. Can I still deduct it?
I have no office space at the school and I am renting.

  1. No, not if it is not required for the business. Those home office deductions are audit flags anyway.

  2. Do you have an office you can use at the school? If the answer is yes, you will be out of luck.

    Keep in mind, it’s a lousy deduction–you have to pay back the depreciation when you sell.

  3. If this is just for your convenience no home office deduction would be allowed on your 1040 federal income tax return.

  4. Your situation must bea unique where the school should issue you a letter to be submitted with your tax return telling that having an office at your home is a MUST and required by your employment contract.
    If this is the case, you can claim ratio of the expenses you pay during the year for running your house or home (total expenses to run the house / squarage ratio of the office compared to the total size of the house). Remember that the home office expenses will be listed in schedule (A). You can not deducted the so home office expenses directly from your income, there is a rule for that. If you are married, the IRS will give you a break of $11400 (in 2009) as standard deduction.
    If you can not show numbers for your home office expenses ($$$) more than the 11K the total amount of Schedule A, it will not help you at all. It will be a waist of time.

    the comparison of the Sq ftge of it to the total Sqftge will be the % you will be able to use of the expenses of maintaining the household, I believe the form # is 8329 you will use

  6. Highly unlikely that it’s a deductible home office. You don’t make money as a result of what you do there. If you met with clients at home, then you would have a good case.

    As an employee, home office expenses are part of a category that must exceed 2% of your Adjusted Gross Income and you must itemize your deductions in order to benefit.
